Appeals Court Keeps Lid on Steroid Tests
A federal appeals court reaffirmed a ruling that U.S. investigators illegally seized a list of ballplayers who allegedly tested positive for steroids. The searches resulted in the seizure of urine tests conducted in a 2003 testing program. Investigators must return the list of 104 players. Elliot Peters, lawyer for the Major League Baseball Players Association, called the case a win "for the MLBPA and for the Fourth Amendment." Michael Raphael, an assistant U.S. attorney in Los Angeles,[link widoczny dla zalogowanych], said the new opinion "lifts significant burdens placed on investigators by the prior opinion," and allows judges in future cases to decide which procedures to apply to computer search warrants.
